Article 1: Applicability
1. These terms apply to the use of the website www.gaytalk.net (“GayTalk”), an online community and dating platform operated by Statix Internet Solutions (“Statix”, “we”).
2. The user of the website and member of the community is referred to as “the member” or “the user”.
3. By creating an account or using the website, the member agrees to these terms.
4. If any provision is found not to apply, the remaining provisions remain in force.
Article 2: Service
1. GayTalk provides a platform where members can create a profile, share photos, exchange messages, participate in the forum and connect with other members worldwide.
2. Basic use of GayTalk is free of charge. Additional (paid) services may be offered in the future under the Statix trade name; members will be clearly informed in advance.
3. We aim for continuous availability but do not guarantee uninterrupted operation. Maintenance and outages may cause temporary unavailability.
Article 3: Account and minimum age
1. You must be at least 18 years old to join GayTalk. If we doubt a member’s age, we may suspend or remove the account.
2. The member is responsible for keeping login credentials confidential and for everything that happens through the account.
3. One account per person is allowed. Creating multiple or fake accounts may lead to removal.
4. Accounts that are not activated via the confirmation email within 30 days of registration may be deleted.
Article 4: Code of conduct
The member agrees not to post content or engage in activities that:
- are unlawful, discriminatory, hateful, threatening or defamatory;
- involve sexual content concerning minors or non-consensual exploitation;
- violate the privacy or portrait rights of others (no photos of third parties without consent);
- contain spam, fraud, commercial solicitation or deception;
- contain viruses, malware or harmful code;
- harass, stalk or intimidate other members.
Explicit profile or album photos may only be posted in the designated protected sections and never in a way that makes them visible to non-members.
Article 5: Content and licence
1. The member retains rights to their own content (photos, texts) but grants GayTalk a non-exclusive licence to display this content within the platform, as needed for the service.
2. The member declares that uploaded content does not infringe third-party rights.
3. GayTalk is not responsible for content posted by members; responsibility lies with the posting member.
Article 6: Moderation, reporting and removal
1. GayTalk moderates profiles, photos and messages. Reported or clearly offending content may be removed without prior warning.
2. Members can report abuse via the report function or [email protected]. Takedown requests (e.g. photos of yourself) are handled as quickly as possible.
3. In case of violation of these terms we may (temporarily) suspend or delete accounts, without any right to compensation arising.
Article 7: Private messages
1. Messages between members are private but are technically stored on our servers. Moderators can only view them after a report or a concrete abuse investigation; every viewing is logged.
2. Do not distribute other members’ private messages without their consent.
Article 8: Liability
1. GayTalk is a platform; meetings and arrangements between members are at their own risk. We are not a party to arrangements between members.
2. We are not liable for indirect or consequential damage or damage caused by other members’ behaviour.
3. Our liability is in all cases limited to the amount paid out by our liability insurance, or at most EUR 250.
Article 9: Changes and law
1. We may amend these terms; the current version is on this page. For significant changes we inform members via the website or email.
2. These terms are governed by Dutch law. Disputes are submitted to the competent court in the Midden-Nederland district, unless mandatory law provides otherwise.
